FishFinderEngine End User License Agreement

1. Purpose of the Platform

FishFinderEngine is a private software platform that collects, organizes, enhances, filters, indexes, and presents publicly available fisheries, lake, and survey-related information, including information obtained from public data sources such as Minnesota Department of Natural Resources ("DNR") resources and APIs.

FishFinderEngine does not claim ownership of raw public data made available by government agencies or other public sources. However, FishFinderEngine does claim and retain all rights, title, and interest in and to the Platform itself, including without limitation its software, design, layout, organization, data structuring, indexing methods, search logic, rankings, filtering systems, visual presentation, custom features, branding, and overall user experience.

2. License Grant

Subject to your compliance with this Agreement, FishFinderEngine grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use the Platform for your personal use or authorized internal business use.

This license grants you the right to use the Platform only as provided by FishFinderEngine and does not transfer any ownership rights in the Platform or any portion of its proprietary systems or functionality.

3. Ownership and Intellectual Property

The Platform contains a combination of public-source information and proprietary technology, compilation methods, formatting, presentation logic, interface design, and search functionality developed by FishFinderEngine.

While certain underlying data may originate from public DNR or other public sources, all proprietary aspects of the Platform are owned exclusively by FishFinderEngine and protected by applicable intellectual property and unfair competition laws, including: software code and application architecture; database structure and organization; search engine logic and filtering methods; presentation layers, dashboards, and profiles; rankings, compiled outputs, and user workflows; branding, logos, names, graphics, and visual design; all custom content, features, and enhancements.

You acknowledge that access to public-source data through the Platform does not grant any right to copy, reproduce, republish, redistribute, or commercially exploit FishFinderEngine's proprietary compilation, organization, or presentation of that data.

4. Restrictions on Use

You agree that you will not, and will not allow any third party to: copy, reproduce, republish, distribute, sell, sublicense, lease, or commercially exploit the Platform or any proprietary portion of it; scrape, crawl, harvest, extract, mirror, or systematically download data from the Platform; reverse engineer, decompile, disassemble, modify, or create derivative works from the Platform; use the Platform to build or support a competing product or service; remove or circumvent any technical, contractual, or access protections; use the Platform in any unlawful manner.

5. Public Data Disclaimer

Certain information may be derived from public government data sources, including DNR databases, APIs, reports, and related records. FishFinderEngine is an independent product and is not owned, operated, endorsed by, sponsored by, or officially affiliated with the Minnesota Department of Natural Resources unless expressly stated otherwise.

6. Accuracy and Availability

FishFinderEngine strives to present data in a useful and organized manner, but we do not guarantee that any information on the Platform is complete, current, error-free, or suitable for your specific purpose. Users are responsible for independently verifying critical information, including legal fishing regulations and real-world conditions.

7. User Accounts

You may be required to create an account to access certain features. You agree to provide accurate and current registration information and to keep your credentials secure. You are responsible for all activity under your account. We reserve the right to suspend or terminate accounts that violate this Agreement.

8. Fees and Paid Access

FishFinderEngine may offer paid subscriptions, premium features, or other paid access. Any fees charged are for access to FishFinderEngine's proprietary software, tools, organization, search capabilities, convenience features, and user experience, and not for ownership of underlying public data itself. Except as required by law or expressly stated by us, all fees are non-refundable.

9. Disclaimer of Warranties

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" TO THE MAXIMUM EXTENT PERMITTED BY LAW. FISHFINDERENGINE DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, OR AVAILABILITY.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FISHFINDERENGINE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIM SHALL NOT EXCEED THE AMOUNT YOU PAID TO FISHFINDERENGINE DURING THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

11. Termination

We may suspend or terminate your access at any time, with or without notice, if we believe you have violated this Agreement, misused the Platform, or created risk or legal exposure for FishFinderEngine. Upon termination, the license granted under this Agreement will immediately end.

12. Modifications

We may update or modify this Agreement from time to time. Updated versions will become effective upon posting or upon other notice to you. Your continued use of the Platform after any update constitutes your acceptance of the revised Agreement.

13. Governing Law

This Agreement shall be governed by and construed in accordance with the laws of the State of Minnesota, without regard to its conflict of law principles.
